DVLA Mistakes, Court and Dates..?


I have made an appeal against DVLA who revoked my License a few months ago for alleged persistent abuse of Alcohol over the past 6 months.

I had to return DVLA question sheet which o sort of did. I say this as I am dyslexic and wrote this on the forms.

A month later I had a medical with a DVLA Doctor and asked for filling in the forms BUT the staff their refused to help me.

I was also meant to have a medical with my GP but there were admin problems between DVLA and my GP so it happened.

I March I got a letter from DVLA saying that they were revoking my License and in their they said by CDT was 1.5%. It appears that a mistake was made on the question sheet because of my dyslexia.

I thus lodged an appeal with DVLA and my local magistrate’s court.

The court said that I had to submit my medical and other which included 11 blood tests over the 6 months owing to an infection in one of my hands and eventually after a couple lots of surgery had to have a finger amputated.

Last month DVLA sent me a letter requesting my consent to approach my GP for unspecified clarification of a number of points. But again admin issues the GP only got the letter last week asking for another blood test.

The date for the test is ONE DAY after DVLA need to submit their paper work to the court.

So what happens if DVLA do not get their paperwork to the court by the required date?

And what happens if my blood test shows a CDT above 1.5% whether its on time or not ?

Hi all,

Been lurking for a while due to finishing university and getting a new job!

It has come to that time whereby I can appear at court to present my case in order for my license to be returned early. As it happens, I have gone past the 3 year mark which was earlier in the month however, I sent an email and a letter to the disqualifying court several months ago stating my case. A lot has changed since I was banned and I believe I have strong reasons for my license to be returned early - just started a new job, relying on lifts as I live in a rural area not serviced by public transport etc. so that isn’t the problem, it’s just getting through to the court. I’ve spoken to the front desk person who obviously won’t put me through to the listings department but so far I’ve not had any useful information apart from the usual please call back later.

I’ve not since heard anything from the court with regards to a hearing date and, even though I understand that courts are busy and listings take a while, several months is getting a bit ridiculous!

Has anyone any experience with this?

Can you clarify what you mean by a 'full licence'?

A 1-year licence can still be a 'full' licence if you've passed your tests, it's just short-dated.

DVLA are unlikely to issue you a longer dated licence solely on the basis that a prospective employer requests it. The short-dated licence is short-dated due to medical concerns. You'd need to satisfy DVLA that it's safe to offer you a longer licence based on your current health.

An employer shouldn't really care what the expiry date on a licence is, as long as employees remember to renew it on time.

An employer shouldn't really care what the expiry date on a licence is, as long as employees remember to renew it on time.

It's not uncommon for logistics companies to favour drivers that have 10-year licences, rather than short duration medical licences. I'm guessing it's a combination of concern that the employee may not have their licence renewed (on medical grounds and because the DVLA can be so unfair) and/or difficulties with the insurance provider. I've seen a few people on this forum find it difficult to get a driving job, after revocation (no conviction). As it happens Mike was disqualified, so that isn't really relevant anyway. Maybe fleet insurance is more expensive for someone with a medical licence (depending on medical condition(s), of course).

I'm assuming you're referring to what @sighingforlife mentioned, as well as getting your HGV classification put back on your licence too? Unless I'm mistaken you have completed the required 3 years sobriety required for this to be made possible. I still haven't read the latest Minutes (stupid me, I know), so apologies if this has also changed.

Yeah I suspected this would be the case.

When I said an employer shouldn't care, I was avoiding saying they won't care unfortunately.

If a logistics company wants to test the medical position of an employee they really ought to send them off for relevant tests, not use ambiguous things like the length a licence is valid for. Even from an employer's point of view, if I had concerns about a prospective employee, it seems sketchy ground to say well if you can convince DVLA to give you a 10 year licence I'm happy. I'd clearly have some sort of concern. I suppose it unofficially can absolve them of some liability if something happens and they can say well the DVLA gave them a licence, but it seems shaky ground.
