Blood toxicology report (back calculation)

My blood alcohol reading was found to contain not less than 19 mg/100ml. UK limit is 80mg/100ml.
The back calculated reading was estimated at 112mg, however, there are several assumptions that have been made/missed in estimating this figure and I want to challenge their findings. The report states it is only an approximate calculation, so, how can I proceed?

Good morning,

Unfortunately the only way I know to go about this is to hire a specialist road traffic lawyer such as myself.

What need to happen is that a lawyer needs to take a full set of instructions and then hire an expert to give a more realistic report of your actual reading. I understand that when the police do back calculation lots of things are not taken into account so your reading may in fact be under. The only way to know to achieve this is to hire and expert but please be aware it is not a cheap process. I do not know of any experts who take direct instruction from clients, and even then the matter would still need to be presented at Court.

Kind regards
Martin.

The person who just called is a criminal solicitor who can’t deal with insurance cases. I need to speak with a specialist road traffic lawyer.

Insurance company are refusing my claim based on the back calculation in the police toxicology report (blood alcohol levels). The result of the report is well below the legal limit, but, the back calculation has estimated a value above the limit (based on subjective data from several hours prior to the time the blood test was done).
