Hello,

I was recently charged with 'being in charge of a vehicle with excess alcohol DR40' and I blew 61.

This is my first offense, I currently have a clean driving license and I have no previous criminal convictions, I am fully sorry for my stupid actions and I am also planning on taking character references.

I was in town and stupidly decided to drive back home to avoid a parking ticket on the high street. I dropped one of my friends off on a quiet road and at that point I was approached by the police. I also currently still had two friends in the car at that time.

I am assuming my aggravating factors are:

Carrying passengers
High likelyhood to drive on

I am so worried about what is going to happen and wanted to ask what I might be expecting? I am obviously planning to plead guilty.

thankyou so much in advance

This offence does not carry a compulsory ban. The court have a discretion to impose 10 points on your licence instead. However, if the Court take the view you would have driven at that level of alchol they are likely to deal with you on the same basis as if you were charged with drink driving. The sentencing guidelines for a reading of 61 in breath suggest a ban of 17 to 22 months and a fine. These are guidelines only and not necessarily set in stone as every case is judged on its own merit. The outcome and exact length of ban will depend on the mitigation advanced on your behalf.

We have legal representatives specialising in drink driving offences all over England and Wales and can arrange representation for a fixed fee. We can provide advice about whether you have grounds to defend the charge and, if not, help you acheive the shortest ban and most lenient sentence possible in the circumstances. Went to court yesterday used the duty solicitor he was amazing - came out with 10 points and a £300 fine which I was over the moon at.

I am a very lucky boy ...it should have been worse.
