Worried about sentence

What sentence is my son likely to expect? it’s his first offence but he had only passed his test 2 months previously . He blew 64 however he did crash the car and had a passenger in the vehicle with him at the time , He is extremely remorseful and being only 18 is petrified about what will happen when he goes to court . Any guidance would be greatly appreciated.

He will face a ban of 23-28 months, which can be reduced by up to 25% if he is offered and accept to do a Drink Dive Rehabilitation Course. (He should ask for it if the magistrates do not offer it as it cannot be offered once his cas is finished in court)
There is the possibility that the court could order him to retake his test as he had only passed his test 2 months before, especially as there was a collision.
He can represent himself, pay for a solicitor to put forward mitigation for him (cost should be in the region of £3-400, no need for a specialist solicitor as mitigation is mitigation, no matter what sort of case is involved) or he can try to speak to the duty solicitor on the day. (This is free but not guaranteed, depending on how busy he / she is)

Either way, he should dress smartly, and try to obtain 2 written references, one preferably from his employer or perhaps his college if he is still in education. (Not a family member because the could thinks that one will be bound to say good things)
His big problem could come when he tries to get back on the road after the ban, at his age, with a DR10 conviction on his licence, insurance will be EXPENSIVE !!

Thank you for the reply , going on his reading the guidelines state a 17-22 month would this not be the case for him ?

It could be but these are « guidelines « , and the court will also consider « aggravating and mitigating « factors. Collision and carrying a passenger are considered aggravating , so this may increase ban length . As Price indicates , onward insurance is likely to be the bigger issue .

Try not to worry about it . It’s not good of course , but fortunately no one was hurt and hopefully it will serve as a valuable learning experience.
Thank you , it’s an awful situation & I will be thankful when it’s over . I know people say it time & time again but it is completely out of character , he’s 18 works full time & has never been in trouble but has recently been suffering with a few problems which I think have contributed to him doing what he’s done even though this is not an excuse . He is 100% remorseful and know how lucky he is that no one killed . Thank you for taking the time to respond .

Good morning again, now I have had breakfast and are fully awake I can confirm that the guidelines ARE 17-22 months!
Sorry for adding to your worries! It is possible that the court can go into the next sentencing bracket where there are significant aggravating circumstances but for a one vehicle accident this is unlikely. He is only just into the 17-22 bracket, which starts at 60 and goes to 89.

Thank you for getting back in touch . I’m expecting the worse case scenario & hopefully if he gets anything less it will be a bonus . I can confirm no other vehicles were involved so I’m hoping that will be taken into account .
