Hi, was wondering if you could give some advice about likely outcomes of this and if you would recommend getting a solicitor?

Have been struggling with alcoholism for some years. Drank heavily for a few days and feeling super tired.
Think I might have fallen asleep while driving as don’t remember crashing into a parked car and apparently scraping along another.

Residents called the police, breathed 85 at the road. Taken to station, was very confused.

Asked if I wanted to do another test, so said, no not really, what happens if I don’t do it?
They said we’ll have to make a note you didn’t do it.
So I said ok then I won’t. Then, actually is that a bad decision?
They said they weren’t able to advise so in the end I didn’t.

Obviously then got written up for failure to supply a sample, which I had no idea at the time might make things worse for me.

Any help gratefully appreciated.

Good evening.

This is one of those cormstances where having a solicitor is really going to help.

Potentially, you may have a defence if they didn't explain the procedure properly. However, on a guilty plea without any indication of intoxication and a serious crash, they will be looking at all options.

A good specialist solicitor will be a big help with this.

Kind regards
Martin.

Thanks for your reply.

Could you just explain what you mean by “looking at all options?”

Also any recommendations for solicitors?

As well as a disqulification you are given a punishemnt. This is either a fine, community punishment (such as probation or work requirement) or custody.

As to recommendations I am completely biased as I do not know of a law firm as good as my own. I am also prevented by law society rules from making referrals to other solicitors I'm afraid.

I would be happy to ask one of my team to give you a free advice call if that would help?

Best regards
Martin.
