i was recently caught drink driving after a night out from a club, i knew i was driving so i limit myself to what i would drink after around 2 ish i stoped drinking and went stright on the water i left the club at hal;f 4. i was pulled over by the police and was over the limit, and was arrested on went back to the police station. i was then tested again by the proper machine and was a reading of 46, the limit is 35. the officer then gave me the option and giving a blood sample but refused a urine sample due to it being apparenly inaccurate. so i then gave a blood sample and now im having to waitg for the result. now when i was giving the blood sample i noticed the lady who was taking the blood had an expired card, her I.D card expired on 6 march 2009, i queried this but both her and the officer made up some excuse that it was ok....but itis ok??? anyways i am now awaiting result thats due in october.

whats my likely punishment? if the blood test were to be over? this is my first and will be last offence and iv been driving for over 3 yrs without a single point....

Whilst you talk about pleading guilty, the first thing that I would say is that defending a case such as yours is possible. However, it is a highly specialised area of law. As such, you are best to seek the services of an expert motoring lawyer in order to maximise your prospects of success. This is particularly so if a ban would result in you losing your job. A conviction would also be a criminal one.

The police frequently make errors in the procedure when a blood sample is obtained. We have dealt with situations like yours before with success and are able to offer advice on whether the procedure was followed correctly with a view to persuading the Court to rule your sample as inadmissible.

We offer 2 levels of service to people who are considering challenging the case against them:
(1) A written opinion on your prospects of success and the defences that can and should be run in your case. This is often used by people who would like to represent themselves or who would like the benefit of our expertise and intend to use a less experienced and cheaper solicitor.
(2) Full representation to trial. If you were successful you would be entitled to reimbursement of your legal fees paid subject to taxation.

If you wanted to proceed further then we would invite you to contact us in order to discuss matters further.

If you wanted to plead guilty your sentence will depend on the level of alcohol recorded in your blood. If you have your own specimen and have stored it properly you are advised to get it analysed asap.

hey, thanks for the prompt reply, i do have the blood sample but i have not kept it cool or anything, the officer at the time gave me no advice just said that im entitled to take a sample and a small booklet with a list of addresses should i want to get it tested so i can get the result quicker apparently.

i would do anyhting to maximise my chances, i know i have done wrong and would never ever so it again but i dont want a criminal recored nor a ban. i am calmly confident that theres a good chance the blood test can come back that i am under but i would also like to talk abit more indepth about the way the blood test was conducted aswell and would appreciate the chance to explore this.

Hi there,

If you wish to discuss your case further the next step would be to instruct us, which can be done over the telephone.

I look forward to hearing from you.

Hello mate,

how longer after your breath test did the doctor/nurse arrive for the blood test?

Im in a similar situation read 47 on 1st reading then 46 on second reading 2 minutes later.

Doctor arrived 20 minutes later, and I gave blood. waiting on results. Just wondering if a 20-25 minute wait is sufficient to bring level below 40? or 80 for blood

just got an inde[pendant blood sample back not the official one and i was 95...abit shocked really...but i spoken to a few legal places and all say i may have a good case on my hands. so seeking legal action and see what kind of case i can put up....my blood test happened 1 hour after my breath test
