Hi there,
I got banned for a year in 2006 for a refusal of breath. It changed my life, I started cycling to work and have successfully addressed alcohol issues. I had to attend a medical to get my license back and because I was honest to the GP, I was only given a 1 year license in June 2008. I said I hardly drank, but on a couple of occasions when fed up I had got a bit pissed. He said I still had a problem and they gave me a 1 year license.
No problem i thought. Now it’s July 2009.
Well, I sent off my details about 3 months ago so that DVLA would re-new my license in June 2009.
But I have been turned down as when my mum died at Christmas I went to the doctor because I couldn’t sleep. H e asked if I had been drinking too much , I said yes.. my mum has just died. He gave me a small dose of diazapan..
Now the DVLA have classed this as an alcohol detox and said I can not re-apply for 12 months.
Now I have spoken to my GP and said I wanted help because of my mums death and because I couldn’t sleep, but he’s reported it to the DVLA as because I had been to the pub for a few days and had drank too much. But, this is not the case.
Even though I have a company car that I can not drive, cycle to work even when I had my license because during my ban I ended up loving cycling, and it’s now part of my new found healthy life. I Play squash and badminton. I drink very socially, 6 pints per month. I feel I have totally changed my attitude to alcohol, for the better.
I Submitted a blood test about 3 weeks ago to DVLA which passed all criteria, letter from my boss saying how proud he is about how I re-addressed my life after my driving ban, I have not driven under the influence of alcohol since my ban.
Now I went to my doctor because I thought I was doing the right thing..!
I obviously need to appeal this decision at magistrates court. Can you please offer any advice, as I am the safest driver on the road, with 0% risk of driving whilst under alcohol, because I have learnt my lesson. But, part of this appeal means I have to contest what my own GP has said.
There is no evidence whatsoever that I am a risk. I could pass a medical today if I was asked, I approached my GP during a very traumatic time, because I thought that it was the correct thing to do as advised by the NHS and I feel very angry that I am being punished like this. Particularly when 50% of the population probably couldn’t get their liver function test below the DVLA requirements, yet they can drive.
Can you recommend any law specialist in stoke on trent area.
I need my car to carry out my duties for work. I have managed for the last month with the train, cycling and my dad. But, there is now way I can continue this until January 2010, especially when I have done nothing wrong and need to stay in employment.
Can you offer any advice please.
Regards
Carl
