hi.
Its my second time drink driving.First time was 3 year ago.
This time i crashed into neighbours brick wall. Had no insurance and blew 133.Is it a custody straight away? Can i go on holiday abroad while on unconditional bail?
Thank you.

Glen,

A reading of 133 in breath usually attracts a custodial sentence. The fact that you have a previous conviction for drink driving 3 years ago makes custody more likely again. The fact that you had an accident will be treated as an aggravating factor. The maximum custodial sentence would be 6 months for drink driving.

You are able to go on holiday if you have been granted unconditional bail providing that you surrender to the Court when required.

If you want to minimise your risk of custody it is essential for you to be represented by an expert in damage limitation and mitigation.
