Drove to pub at 12:09. CCTV. Scraped another car.

Woman called police got arrested inside pub having had 3 pints.

Blew 140 at 4pm at the station BUT hadn’t got in the car since 12:09 (so hoping that gets reduced by say 6-70 so down to 100 or so perhaps but unsure.

Also then found out my partner hadn’t done the mot or tax since feb (car is in her name). I had been paying the insurance unaware of this and she is happy to confirm that.

Terrified I’m going to prison. First offence but have 6pts for speeding a year ago (37 in 30s).

I was polite to the custody officers and in the interview. I plan to attend aa etc before the case and never drink again and sell the car.

Any chance I go to prison here?

I would speak to a defence solicitor.

If you got breathalysed 4 hours after driving and there's evidence you had 3 pints at the pub then the breathalyser reading is not reliable. A back calculation can be ordered, but a defence solicitor may well be able to cast doubt over the process.

I hope so. There is clear evidence that I had a further 3 pints since the offence yes.
 
No you won’t go to prison, but definitely worth taking legal advice if you can afford. Keep record of everything, receipts or bank statements to show when you bought drinks

another question. Once they look at cctv for say tuesday, will they then look back at other days of cctv or is it the only the things I've been charged for?
 
it is very unlikely you will go to prison
you didnt kill anyone ,not even injured anyone.prisons are full ,you will get ban and fine .
will ban affect your employment? if yes I would seek help of professional lawyers (motorists offences) before your first hearing

They're incredibly unlikely to go through past CCTV footage unless there's an allegation you're a regular drink-driver at that pub.

But then, why would you be concerned if they reviewed past CCTV footage...?

With any decent criminal defence solicitor surely you'd be OK - you was arrested 3/4 hours after been seen driving and was found in a pub drinking. With multiple witnesses i assume that would corroborate this and CCTV to support it! The back calculation is there only viable angle and this isn't an exact science anyway (something i went through) - you yourself pay a toxicologist to support your defence after telling them your side (after speaking to a lawyer...)

Go get a brief, even if you're skint find the money because i think you've got a fair bit in your favour (if what you're saying is totally true)

FYI who cares if they check the prior days, they wouldn't be able to re-arrest you for any of it in hindsight anyway (the police are underfunded, and you aren't Pablo Escobar - in my case, before trial, i was thinking about loads of things i thought the police might do (simple things like checking bank records to corroborate timelines) - never happened).
