Ok, i went out with fiends on late night friday 06/11/09 and we really did some serious drinking, which didnt stop till around 12.30pm on saturday. Id had about enuf at this time and so i went home in a taxi and slept through till 9.30pm. I woke up feeling fine, head wasnt hurting, and i didnt feel groggy and so i made my wayb ack to my friends house who was having a few drinks.

One of my other friends who had just had an operation on his arm was in extreme pain, and as id only had about 3 and 1/2 330ml bottles, i said id drive him to his house to pick up some of his specially prescribed painkillers. At the time i felt fit enough to drive in my own sense, i wasnt stumbling, sppech was clear, i could think straight and this was when i was pulled over for speeding through a 30 zone at 3am sunday morning. Im not justifying it but the roads were dead an i was puttin no-ones life in danger.

Anyway, i was made to do a breatherliser at the side of the road, which the first one didnt work, and so was made to blow throught the same piece again- Failed.

I was taken to the polic station were the lowest reading i gave out was 71mg (breath). I was a bit confused as i didnt feel drunk or even feel twice over. I am summonsed to court 24/11/09 and i am feeling i really need some legal representation.

It is making me sick with worry as I am in my second year training to be a Social Worker and I think that a conviction would most definatley get me thrown off the course and struck off the General Social Care Register.

I am also a learning disabiliy support worker and i am worried it will efect the people i support as the use of my car is essential in supporting them in the community as well as taking them to hospital, doctors app ect.

I am really sick with worry that this could ruin my life. Any thoughts would be much appreciated as to ban length ect. I am 22 and have held my license for nearly 3 years. no previous convictions.

You are likely to be sentenced to a ban of between 17 - 22 months from the reading that you have outlined. This presupposes that you intend to plead guilty to the offence with which you are charged.

Should you require a Solicitor it is important to instruct one as early as possible. Drink Driving law is a highly specialised area of law. As such, you are best to seek the services of an expert motoring lawyer in order to maximise your prospects of success. This is particularly so if a ban would result in you losing your job. A conviction would also be a criminal one.

Whilst you may be able to use a duty solicitor at Court, their services are not guaranteed. Furthermore, if you are lucky enough to speak to one you may only get 5 - 10 minutes at most and you will have no control over the skill or expertise of the duty solicitor at Court that day.

The police frequently make errors in the procedure, either at the road side or at the police station. We have dealt with situations like yours before with success and are able to offer advice on whether the procedure was followed correctly with a view to persuading the Court to rule your breath sample as inadmissible.

We offer 2 levels of service to people who are considering challenging the case against them:

(1) A written opinion on your prospects of success and the defences that can and should be run in your case. This is often used by people who would like to represent themselves or who would like the benefit of our expertise and intend to use a less experienced and cheaper solicitor.

(2) Full representation to trial. If you were successful you would be entitled to reimbursement of your legal fees paid subject to taxation.
If you wanted to proceed further then we would invite you to contact us in order to discuss matters further.
