Hi Hammond,

Is there a way in mitigation circumstances to avoid a ban? And instead, get points or community work or even payments?I pleaded guilty with mitigation and awaiting sentencing and my world has fallen apart

Unfortuanly not.

The minimum ban would be 12 months unless any special reasons about the incident apply, such as a shortness of distance travelled or an emergency circumstance. The only thing that could reduce it further would be a Drink Driver Rehabilitation course which would take a further 25% off your sentence

Pstd and had to pick my daughter up at a friend's as I was paranoid she was getting assaulted. It was not my intention to drive

I don't think that would be enough to run as a special reasons argument from my experience but there would be no harm in you talking to a lawyer and investigating the matter further.

I am in £7000 debt in Solicitor costs so am representing my case. My probation said I needed a full report made as I was in distress and with a difficult situation in regards to my mental health. Could he be of any help?

Ah I see.

I'm sorry but I cannot give advice as to what your solicitor could or could not do due to Law Society restrictions. I think you need to speak to your solicitor if they are still instructed and go through your options.
