Permission to drive in Wales if found over the limit prior to Court appearance?

Good afternoon. My Client, awaiting diagnosis of ADHD, is under my care. He has been found driving whilst over the limit and given a date to appear before the magistrates. As I am unsure of the legalities in Wales regards to instant revocation of driver’s license as would be the case in England. My Client believes he is able to drive until convicted. It will be a guilty plea with mitigating circumstances. If, as advised, common sense dictates he must plead guilty, the sooner the better in the eyes of the Court, however at what point is his license revoked? My client believes it is only when found guilty by the Court he is unable to drive. This is something I have never heard before, albeit in my minimal knowledge of Road Traffic Offences. I am a specialised Psychotherapist and advocate for Adults with ADHD and will be representing my Client so need to be best informed asap.

Good afternoon,

As a lawyer I would need a lot more information before I could confirm your clients driving status, however I can say it is normal that defendants continue to drive until they plead guilty or are found guilty.

I would also add that you would be unable to to represent your client at Court, only a person with rights of audience or the defendant would be able to make representations.

I hope this helps.

Kind regards
Martin.
