Somebody was caught driving illegally and charged with "Driving a motor vehicle otherwise than in accordance with a license" and "Use of a motor vehicle without third party insurance" however, when summoned to court this person never went and telephoned the court to give a reason for absence and told the person on the other end of the phone (Just a receptionist) they wanted to plead guilty. The receptionist informed them they'd have to send a written plea which they never did. The next communication they get from the court is a notice of fine and collection order to the amount of £600. Is it legal to prosecute somebody without them putting a plea in?

Also to mention, the court has the wrong date of birth for the person and at the time of prosecution the person was 18 and it was taken through youth court, is this still a valid prosecution?

Edit: Just reading form EX340, it seems they can't appeal to the county / high court as they've left it too long?

The Court's will prove cases in absence where the person summonsed does not attend Court in order to answer the allegation. This is perfectly legal and acceptable.

There is an option to apply to the Court to reopen conviction and sentence. This is something which may be easier for a Solicitor to deal with as it can get complicated procedurally.
