Hi all, i was pulled on Saturday night just gone, after a stupid decision to go out and collect a friend after the idea was put in my head! I have recently suffered a really bad relationship breakdown and have been away from my support network for a few months and the affect on my mental health has been horrible on my own. This is my 1st offence and i was parked up when was actually pulled with no1 else in the car, i complied and took it on the chin, i blew 104 at the station, i did explain i had nothing to eat and my medication earlier in the day. Needless to say i feel mortified about the whole situation. And wondering if anyone can shed some light on what to expect at court, sentencing etc? Thank you appreciated.

In simple terms, you will face a ban of 23-28 months, a community penalty (you can read about that here: https://www.gov.uk/community-sentences
Or a fine.
The ban could be reduced by up to 25% if you are offered, and accept, to attend a Drink Drive Rehabilitation Course. (Ask the court at the time if the magistrates do not mention it, the course cannot be offered as soon as the case is closed.
Turn up to court well dressed, apologise for taking up their time, and that of the police. You can get a solicitor to do this on your behalf but you should not pay a lot of money to a specialist one, any competent solicitor can submit mitigation and the charge should not be more than £300-400. Alternatively you could try to get the duty solicitor to speak for you on the day (this is free) but not guaranteed, depending on how busy he / she is.
Try to get two written character references, preferably one of them from your employer.

At the end of your ban you will face a medical that has to be passed before you can get your licence back. This includes enquiries about your drinking habits, medication you take and your mental health, so now would be the time to start putting your health in order, rather than waiting until the last minute and then facing delays in the process when you apply.

Hi there, I blew around the same when I was done 3-4 years back.

Was shitting myself, but my lawyer said I definitely wouldn’t face anything worse than community service; which he (and probation guy, who really sympathised with my circumstances) did well to avoid. Because of my work/divorce/other stuff going on they were sympathetic, so hopefully they will be with you too.

Ended up with 24 month ban reduced to 18 after completion of the course. The lawyer hoped for better but I was unfortunate enough to get a district judge rather than a magistrate. No CS thankfully, but that was at the expense of a whopping (four-figure) fine. But CS would have screwed my (already-doomed) job, and would have all-but written off access to my kids for a while.

So I was pleased enough with the outcome given how stupid I was.

Maybe you’ll fare better, I certainly hope so. Good luck.

Community service can also be done at the weekend, so you may not be clear of having to do that yet.
The court sometimes consider an alcohol tag instead, depending on your offending history if community service is found to be impractical.

My 1st offence mate, but said id be sentenced at another date

If they are considering a community penalty or a prison sentence then they have to adjourn for reports to be prepared.
In busy placed the court will get yo to see a probation officer at lunchtime and get you back in the afternoon. In quieter places they do not have probation officers on tap so they adjourn the case for a month.
If they deem that community service is not possible, they do sometimes increase the fine to compensate.
