My son was caught drink driving in October blew 63 , he was taken to the police station and released shortly after under investigation having not being interviewed . We have heard nothing since until yesterday when they rang to say they needed to interview him this could either be done at the station or at home . We agreed to the interview at home until the office told us there were two charges , drink driving & driving without due care & attention on finding out about the second charge we told the officer we would speak to the solicitor to take some advice , the officer then said he would Speak to his Sargent to see if they would just go with the drink driving . He rang straight back to say they would just go with the drink driving charge and due care and attention would be dropped . I just want to find out if anyone else has been interviewed at home & what to expect .
 
the one advantage to being interviewed at the police station is that your son is then entitled to ask to speak to the duty solicitor to represent him in the interview. This is free.
There is nothing to stop him having a solicitor at the house, but you would have to pay for that.

The issue about being interviewed at home or the station without a solicitor is that he will have no idea about how the interview will be conducted or what they want to ask him.
Was he caught actually driving?
Did he have an accident? … if he did not have an accident was he told at the time or in a letter within 14 days that he was under investigation for driving without due care and attention (this is not required in the case of an accident)

If he has a solicitor, he /she would ask the police before the interview about what evidence they proposed to put to your son. If he felt that they were ‘fishing’ for some admissions because their case is weak then he would probably Advise a ‘no comment’ interview.

He did have an accident the car toppled but no other cars were involved , I don’t believe they witnessed him driving as the police arrived at the scene after the accident had occurred however they have told us they have cctv of him and the passenger getting out of the vehicle .We were just given a standard printed letter when released from police station stating released under investigation.
 
In which case they may not have the proof that they want to show that he was driving. “It was him or his friend” is not proof that ONE of them was driving.
All the more reason to consider a “no comment” interview, at the station, with the duty solicitor.
