First time Drink drive due to mental Health issues

Hi,

Before Xmas I was going through a tough time and tried to take my life. I was unsuccessful and the local public found my car where they alerted the police. They breathlized me at the side of the road and I was over I was then taken to the hospital and spent the following week on a voluntary mental health ward.

Police took bloods at hospital and results were 87 and I believe the limit is 80 so I was just over.

The police have asked me to go in to give a statement and then a court date will follow. I am terrified as it is my first offence and was in a very bad way at the time. I am wondering will I get free court representative on the day or do a need to pay for a private one. I am planning on pleading guilty and hoping the court will understand my circumstances.

A reading of 87mg of alcohol per ml of blood is a relatively low reading albeit still over the limit of 80. You will be sentenced in line with the lowest sentencing bracket so will face a ban of between 12 and 16 months together with a fine. You personal circumstances will be considered by the court but only in as far as providing mitigation to hopefully keep the ban to as low as possible. It will not be enough to avoid a ban. A solicitor can help you to present that mitigation but you won't be eligible for legal aid for this type of offence with a reading that level. Before legal aid can be considered for this type of offence you have to be at risk of a prison sentence which is not a consideration in your case.
