Evening ,my son ,aged 18 crashed and was charged with D/D breath test reading 47.

He drank in evening, slept in car till around 5am then drove ,crashed .no other parties involved,police breath tested him charged him n took him to a cell till around 11am .is it worth being represented by a solicitor ?

A reading of 47µg of alcohol per 100ml of breath falls into the lowest sentencing bracket. This means that the court would ordinarily impose a ban of between 12 and 16 months together with a fine. The crash will be considered as an aggravating factor and could mean the court look towards the higher end of the bracket (47 would ordinarily be dealt with closer to the lower end of the bracket). Representation could be helpful in outlining relevant mitigation surrounding the sequence of events and other issues in your son's background that are of relevant consideration. Representation would not be available on legal aid for this matter and you would have to instruct on a privately paid basis.
