A family member was tested at the road side on Friday evening and the reading was 90. I'm so worried as his family really on his income and he needs to drive to be able to get to work and assist with the childcare needs..ie transporting the youngest to and from nursery at odd times to reduce the costs. I know reading through previous threads that he will loose his licence. Given the circumstances and the needs would it be advisable to get him legal representation to try and over turn the ban?

Unfortunately, this offence would always attract a minimum ban. Personal circumstances cannot avoid a ban for an offence of this type.

A reading of 90µg in breath means that he will be sentenced in a bracket whereby a ban of between 23 and 28 months will be imposed together with a community order. There are potential technical defences to this offence. You will need to speak with a specialist on 0333 323 3940.
