Drunk driving

Hi all, I was arrested for drink driving the other night. I blew 0.57 on breathalyzer but was taken to hospital for injuries as I crashed into a tree. They said they discard roadside test and the urine test I took 4hrs later is what they base it off. I was de-arrested in the hospital and never taken into custody. I am now awaiting these results and I’m terrified of a prison sentence.
I don’t have a criminal record
It’s my first offence
No injuries
No passengers
At 2am so no one on the road
And no pedestrians about

My aggravating factors
I crashed
Lengthy journey


I’m very scared of going to prison, really need advice as my mental health is very low atm. Please help

Good afternoon,

Firstly it is extremly rare that people go to prison on a first offence but without a urine reading it is very hard to guess what will happen to you. If you are a low reading you will skirt the line between a fine or a community punishment so try not to worry too much.
