Had a few should not have driven but did - drove into town centre with friend, stopped for pulling up too early at lights. Pulled over straight away - asked if I'd had a drink - yes, had a pint - no kit to take test, sent for another car, waited, waited, as it came ran (by this time I had gone through the motions), did not get far. Co-operated from then on.

Blood Alcohol Level and Reading Type:
71mg breath

Mitigating Factors:
2nd conviction in just over 3 years

Yes - An excellent solicitor at £225 p/h capped at £500. Total cost £600 inc. VAT

Sentence:
3 Year Ban £500fine + cost totalling to £635

Yes - We asked for it and fortunately was offered and duly accepted

Sentence Comments:
I thought I was going down for this and would of took community service or even a suspended all day. I had to wait a month until I was up and had some dark thoughts going on inside my head. Worried my family would be affected etc etc etc It being my second offence and the fact I tried to run off. I am ashamed that I am celebrating but I am so relieved and happy with the outcome. My advice is obviously never drink and drive, however, if you are stupid enough to do it, like I was (for the second time) and are facing court get a good solicitor, it makes a big difference - a big big difference. Respect those in court and turn up on time, fresh and well groomed.
If anyone is facing court be strong - yes dd is against the law and wrong but it does not make you a scumbag. Good luck.

Had a few pints of guinness in the night whilst out with the mrs, had a big argument and stupidly jumped into my M3 to get the anger out at around 1am and had a high speed accident on the dual carrigeway at around 2am. moved the car a short distance from where the accident took place to get it out of the way of the road...

Brief Description of Offence: PLEASE NOTE offence was December 2011
After surprising my then partner with his ex girlfriend, i went home & through the afternoon/evening drank over half a ltr of Vodka with tonic. Went to bed after taking 1 sleeping tablet & a glug of Nite Nurse.Woken by flashing lights, to find myself driving my car about half a mile from my house. Was initially pulled over for driving slowly.(Obviously a black out). Was kept in cells for 12 hours, released to a responsible person next morning, despite reading still being VERY high.

It took a total break down, the loss of my job & 18 months to get back to "normal" health and i was then able to read the paperwork, digest & accept the sentence and see how it could have been much much worse.The Judge commented that my chance of re-offending was very low and i did not need a curfew or an attendance program. I now have the Medical to pass next week and hopefully the return of my license in the new year.A VERY VERY expensive 2 years & no doubt in years to come.
 
Brief Description of Offence:
I was running late the night before, so drove car to the train station rather than walking. Caught train into town and stopped drinking around 12:30am. Caught the night bus home at 01:30, and from there walked a friend home which took another half an hour or so. Friend's house happened to be next to train station, so decided to jump in the car and drive the 1 mile home. Police car passed in opposite direction, turned around and pulled me over...

Sentence Comments:
I don't believe I really had a foot to stand on, they basically threw the book at me, understandably so. My only query looking back, is that the officer's only reason for pulling me over was the time and place.
 
Brief Description of Offence:
Long story but to try and summarise: I Had been drinking the previous evening starting at approx 8pm and ending at approx 1am (approx 6 glasses of large white wine but on an empty stomach)and following some distressing circumstances in which I got seperated form my friends, was nearly raped and lost my handbag, I managed to get back to my car which was at my friends house (hadnt got my phone, or money to get home and I couldnt rouse my friend whose drive my car was on- I wasnt aware she was back at home in bed and assumed she wasnt coming home. It was also freezing cold and I was worried about my own safety haviing been attacked some hours before), so after several hours (approx 4) of sleeping it off I stupidly decided to try and get home early the next morning, as I felt ok to drive by then.

Mitigating Factors:
clean driving record, no previous drink driving / criminal convictions, co-operation with the police, not an emergency but certainly hadnt planned on driving- was due to a bad set of circumstances (as above).

Aggravating Factors:
Didnt know the area well and managed to enter onto a ringroad, travelling in the wrong direction, which is obvioulsy what alerted the police's attention!

Yes. As nice as he was, I wouldnt say it was worth the money really as I think he could have made more of the mitigating circumstances.

Sentence:
Length of disqualification (18 months) , fine and costs amounted to £500.

Offered the Drink Driving Rehabilitation Course?:
Yes and I intend to take this as it should reduce my ban by 4 months.

Sentence Comments:
Could have been worse I know, but this will massively affect my job which requires a lot of travelling and they cant reduce/alter my workload. I wrote a very detailed and very apoligetic letter to the magistraite who I was told had read it before I entered the court room. Im not convinced this was the case! I thought they may have looked more symathetically towards me and the reasons why I decided to drive that morning. Thought this may have taken it down to the 17 months but I guess beggers cant be choosers and I should be greatful that it wasnt more.

Emotions:

Where do I start with this one? The whole experience has been utterly horrendous. From being arrested and detained in the cells for 16 hours, to going to court today and being treated with distain. Waiting to go to court over christmas and the new year has been one of the darkest times of my life. I have had previous mental health issues which are back with a vengeance. Im taking valium for anxiety, medication to help me sleep, and anti-depressants. Even though it has now been a few weeks ago, I wish I could turn back the clock and didnt make the stupid decision to drive my car. I dont have the luxury of a partner/people whom I can rely on for lifts and I will have to continue the HP payments for a car I wont be using. The list goes on! The worse thing is knowing that I now have a criminal record which shouldnt be used against me in future employment, but hey, we all live in a world, certainly at the moment, whereby it gives people a good excuse to get rid of you/not hire you in the first place. The stigma of what I have done, and the shame I feel is also crippling me emotionally.

Yes - would reccomend this course to anyone, even people who have not been convicted - very educational and should be a necessity to be taken as part of the driving test

I expected this sentence really, due to reading alot of the others on this forum (this really gave me a good idea of what I'd be receiving).
 
Brief Description of Offence:
Parked car at the pub. Got very drunk. No idea why I got into the car - don't remember; stupid I know especially as I usually walk home as it's 10 minutes walk! Got less than half a mile crashed into a parked car. Family came out took me in, called the police. I complied and was released on bail the following day.

I have a clean license, no criminal record, complied with the police and had support from work (My sales director was present). I had 3 very good personal references and one excellent one from work.

Went to Court yesterday: 32 month ban (hopefully reduced to 24 with Driving Course which was offered, costs and damages totaling £130, 6 month community service (details to be confirmed tomorrow), 3 month electronic tag

Yes - definitely intend to go

Sentence Comments:
I thought it best to get legal representation given the high reading. I'm a reasonably confident person but you'd need to be very confident and maybe with a much lower reading to represent yourself; it's a very nerve wracking experience. Even more so when we adjourned and I spoke to the probation officer who informed me that I had "quite a harsh bench" that morning! This didn't help! The probation officer I think was trying to avoid a custodial or suspended sentence as she must've know these particular magistrates. I don't think i expected the curfew to be honest but I guess I'm just going to have to take it on the chin (or the ankle!); as a 39 year old director it's going to be odd but combined with the community order it's certainly a lesson learned. It could've been a lot worse...

16 Month Ban (Down to 12 with DDRC) - £435 Fine - No Mention of Retest

Sentence Comments:
Although I am happy to see this behind me for a first offence I am perhaps slightly disappointed with the maximum 16 month ban. Regardless, I have learnt an important life lesson and the fact that the judge did not mention a re-test has put my mind slightly at ease. I am happy I can now move on with my life and see out my ban and pray that I do not have to take a retest at any point. I am still under the New Drivers Act so its still very iffy, my solicitor told me it was at the DVLA's discression however reading on here Im not sure if that is fact? Either way I am never going to drink drive again and I can look forward to many things to come.

Tips for Court - Dress Smart - it really does make a world of difference. I was first in that day and there were no press in the court room (or so my solicitor said), get good character references and NEVER do it again.

Yes/No - Duty solicitor spent 5 mins with me before but then represented me in court. He was excellent but I was very prepared with quality references (see online help), had written a statement (as I though I would be representing myself) with all the knowledge that I had gathered.

Sentence:
24 Month Ban (Down to 18 with DDRC) - £0 Fine - £145 Costs. 2 month curfew (Mon-Fri 9pm-7am) No mention of re test.

Offered the Drink Driving Rehabilitation Course?:
Yes - This will be done.

Sentence Comments:
Dress smart and do your own research. I don't believe a solicitor is required in every instance and for every person.

Brief Description of Offence:
Had court Today!!
Had some wine with my good buddy after he told me of his Cancer. Was really upset but decided to drive home as I wanted to get back to the family. Got arrested on my doorstep after being reported by a member of the public saying I was swerving on the motorway.

Blew 97 and 92.
92 used in court.
Don't know roadside reading, just saw the light go Red so said "its a fair cop, I'm guilty"!

Mitigating Factors:
First offence, driving for 36 years. Pleaded Guilty to the Usher-very early! Good character refs. CPS evidence mentioned that my friend had Cancer as I had talked to the arresting police officer about it all the way to the station! BTW, my buddy is responding well to Chemo, had his fourth session this week and the source cell is shrinking! So I'm hoping he will be around for as long as me!

Distance driven 30 miles and reported for 'Swerving' on the motorway. When we got to see the CPS evidence, there was no witness statement for this so it wasn't used - hearsay!

I was expecting Medium CO at least and a bigger fine. Although the sentence will allow me to continue working I got off lightly considering the high breath reading. I send my apologies to all those who got worse for less, but it really does boil down to the mood and type of magistrates you get. They switched courts on me at the last moment and thankfully I got the 'soft' bench. The other court were doling out sentences based upon the guidelines, so I got really lucky.
I had my last drink on the 22nd Feb 2013 the night I was arrested, and don't intend to have any again. If everyone could experience the depths of despair and shame that being caught drink driving causes, it would happen a lot less. I have learnt my lesson, I had 5 weeks to contemplate the whole event and the effect it has had on me, my family and my friends and work collegues. Thank God I didn't have an accident and that no others were hurt. Zero tolerance for DD is maybe the best way to go BUT breathalysers in cars would at least make you think twice, especially if they are linked to the car so it wont start. I was very happy with the time of my ban, I was expecting 17-22 months, the duty solicitor told me to expect 18-24 months, so when i was told it was 14 months reduced to 10 with the course I was very relieved. i found the judge fair and polite. It was very scary representing myself, but it went quick.

Short distance driven, less than 2 miles. Cooperated with police, named myself immediately as the driver, clean driving license and no convictions.

Sentence Comments:
Wearing a suit definitely helped, can't emphasise that enough. My references, personal letter to the magistrate and help of the duty solicitor helped move the magistrate away from the 16 months that he would have most likely imposed down to 12. The prosecution didn't take too kindly to this. I honestly felt the sentence was possibly too lenient considering he didn't seem at all concerned about the accident with a lamp post in a pedestrian island. It was a great result, and it's been a real eye-opener. I've been extremely lucky and next time they won't be so lenient... but I'm going to make absolutely sure there is no 'next time'.

Was late at night after a shopping trip and a few drinks with friends, led to few more than expected drinks and stupidly thought I was ok to drive home
On the way home in the early hours on the motorway my tire blew out and my car lost control and was sent into a spin and rolled onto it's roof and crashed into the hard shoulder, I left the scene in panic but was caught by the police! Taken to hospital and blood taken

Drank 4 cans of lager and a single shot whisky and coke, finished around 10:30pm and was drinking for around 3 hours, call from friend around 3 hours after I had finished drinking 1:30am no way to get home, picked up thinking I was under limit and was pulled by police

If a person commits the 2nd OFFENCE within 10 years of the PREVIOUS CONVICTION i.e 9yrs and 12 months then they are classed as repeat offenders, they are high risk offenders and must take a DVLA medical before the licence is returned as well as 3 year ban and fine, I was very lucky the 1st offence was over 10 years ago, the sentance I recieved was the same as a 1st time offender, lesson learned I will never drink and drive again no matter the circumstances, i found out at the alcohol assessment meeting the police set up for me when I committed the offence it takes roughly 1 hour per unit to get the alcohol out of your system I should not have driven untill 6 am the next morning, massive error on my part and I will learn my lesson.

Went out for a few drinks with friends at the end of October, after drinking a lot I made the stupid decision to drive home.
Got pulled over and failed the roadside breath test. (I was well over the limit I think)

Failed to provide a specimen of breath at the station. (on purpose I blew too hard as I knew a high reading would see me off the road for ages). I told the officers I was really upset I had failed to provide a sample.

None, I was co operative and acted non drunk, the officers even put on their report I was polite at all times.

Sentence:
12 months reduced to 9 after course. £525 including court costs and victim surcharge

Yes booked to take it

Sentence Comments:
I was expecting a long sentence about 24 months for failing to provide but thanks to great solicitor they got me the minimum sentence. They said even they were surprised I only got 12 months as the other people in that day had got very long sentences.
For me failing to provide worked out for me as a true breath reading would has seen a very long sentence.

I may have got off lightly for a failing to provide offence but 9 months off the road employing someone to drive for me and the loss of work will probably cost me about 20k.

I have learnt my lesson.

For anyone else you have to get a solicitor to represent you, it was the best grand I ever spent.
 
Brief Description of Offence:
Out at a Christmas party, drove home and was noticed swerving and failing to indicate down a left turn. I pulled over of my own accord, then the police pulled up behind me and smelt alcohol. They tested me roadside.

Yes, and worth every penny. I wouldn't have felt confident without representation navigating the court system, and would have got a higher sentence. See below.

Sentence:
24 month (18 with course) and a £850 fine (including £110 court fees and £70 victims surcharge). The fine was so high because I was trying to avoid a community service order (which I should have, in theory, got given my high reading).

Yes (will attend)
Sentence Comments:
I was keen to avoid community service and/or a curfew, which because I had a high reading I was expecting to receive. The solicitor did a great job in convincing the court that this would have a serious impact upon my professional and personal life and they opted instead for the lesser sentence of a ban and a high fine. I wouldn't have been able to achieve this result without a solicitor. At the very least get the duty solicitor.

Some general comments: don't worry about the court process, it's not as intimidating as you think. Wear a suit, for sure. Get some character references, they definitely help. Be polite and show remorse. The worst time is that horrible few weeks between being arrested and going to court. Once court is out of the way you will feel infinitely better. Try not to beat yourself up. Life goes on.

Overall quite pleased with the result, the duty solicitor told me that i would get no less than a 24 month ban and a minimum of £400 fine,
so with the course its a 12 month ban and 800 fine.

Glad its over with, but hey it could of been worse.

A couple of comments. You quote the fee for the course as £280, that is too high, none of the providers charge over £250 some £100 less, and you can chose the provider that you want, not just the one that the court told you about.
You say you will get the course done for November, in fact you will have to complete it by August, 7 months from the date that you were convicted, ready to apply for your licence back for October time.
