hello, i was pulled over late at night coming off a motorway i was answering the phone to put on loudspeaker when pulled over i was breathalyzed the reading was 73 this went to 63 i was charged at the police station and charged using a mobile phone.
19 years ago i was caught drink driving twice i have had a clean licence since.

is there a risk of custodial sentence and is it recommended i get a solicitor or can a duty solicitor help as much. im a elderly carer and i care for my daughter special need my car is most important but i do understand its my own fault and the court will look at it like this to. is there any advice someone can give please ?
 
Good morning,

If you can afford it I would always recommend a solicitor as you are always more likely to get a better result. The duty solicitor will be free but will also be busy with other cases and will not give your case anywhere near as much time as a privately paid specialist.

As to prison, custody is always an option for the Court but given that your last offences were long ago, I think custody would be a last resort. Community punishment is likely given the phone and previous convictions and even if they consider custody I would image it would be a suspended sentence.
