Hello there,
Is a driving ban of 12 months mandatory if caught for drink driving? Are there any circumstances in which this could be reduced as a driving license is needed for employment as a delivery driver. Would it be helpful to take a drink drive rehabilitation course before sentencing at the Magistrates Court?

Yes, mandatory minimum 12 month ban - depending on reading/circumstances etc. Can be reduced to 9 months (or up to 25% reduction) if you take the course - you have to be offered it by the court when you are sentenced.

As James had said pal, I'm an hgv driver pal, so I know how important my licence was, and I was still an arsehole. If you took a drink driving course before sentencing it would only be for educational purposes. You would not get a reduction in your ban. Swallow ya medicine unfortunately

A minimum 12 month disqualification is mandatory when convicted of drink driving unless special reasons not to disqualify are established which are very rare and must relate to the commission of the offence only rather than the impact any sentence imposed would have on an offender.

For example you could possibly argue a special reason case if the reason you drove was to take a loved one to hospital in a life threatening emergency and there was no other practical means to get them there. If a special reason was successful you would still be convicted of the offence, however the Magistrate would have the power to impose a lower disqualification than the mandatory minimum or no disqualification at all.

James is correct you can only take the drink driving rehabilitation course after you have been sentenced and must be offered the course on the day you are handed your sentence in order to take & complete it afterwards. Completion of the course can reduce any disqualification imposed by up to 25%, meaning a 12 month disqualification could be reduced to 9 month after completion of the course.

The drink driving course is not related to special reasons.

The majority of first time offenders are usually offered a chance to complete the course, however it must be offered on the day you are sentenced in order to complete it. If you are not offered it on the day of sentencing then ask for it as it cannot be offered afterwards.

Once accepted you will need to complete it by a certain date in order to benefit from the reduction in disqualification.
