Hi,
I recently crashed my car into a fence on a country road, the police were called and I failed the breathalysers scoring 60 micrograms of alcohol in 100 millilitres of breath (the limit is 35) I was taken to hospital to treat my injuries and 4 hours later tested 47 micrograms of alcohol in 100 millilitres of breath at the police station, the police then asked for a blood sample which was taken 2 hours later (having nothing to eat or drink in this period). Has anybody got any advice? I have just started working for a new company and my role is nationally based so involves a lot of travelling should I be convicted, is it at all possible to avoid a driving ban as I will lose my job. I currently have 6 points on my licence for driving uninsured 3 years ago.

If you are convicted of driving with excess alcohol (DR10) you will receive at least a mandatory minimum 12 month driving disqualification and a fine. You should also receive the opportunity to take the drink driving rehabilitation course which can reduce your ban by up to 25%.

Whether or not you are convicted will depend on the results of your blood test analysis. You should follow Seans advice and arrange an independent private analysis of your blood sample. Apart from this, you can only wait until the police receive your blood test results. If you are to be charged, you should consult with a solicitor who specialises in road traffic law and drink driving cases.
