Hi there,

my bf just got arrested under drink driving which he never did before. he has put his permenant residents application in for approval and been awaiting for the results. how much would this offence affect his application? What should we do about this?

I dont know what the reading was taken in the police station but i guess it would be quite high. Do we have a chance here if we seek legal help from the solicitors? thanks in advance
 
Your boyfriend will be sentenced to a ban (length depends on the reading) if he pleads guilty or is convicted of the offence in question. If the reading is very high your boyfriend may be at risk of a prison sentence.


I think that your boyfriend needs to receive legal advice. Should your boyfriend require a Solicitor it is important to instruct one as early as possible. Drink Driving law is a highly specialised area of law. As such, he is best to seek the services of an expert motoring lawyer in order to maximise his prospects of success. A conviction would also be a criminal one and he would need to check with an immigration lawyer to see if it would affect his application for residency here.

Whilst he may be able to use a duty solicitor at Court, their services are not guaranteed. Furthermore, if he is lucky enough to speak to one he may only get 5 - 10 minutes at most and will have no control over the skill or expertise of the duty solicitor at Court that day.


The police frequently make errors in the procedure, either at the road side or at the police station.
