Im facing a ban on a reading 77 in breath. I lost control of my car and hit the kerb, my car is a write off, no other car or person was involved and no property damaged just my car. i pleaded guilty at the time at skemersdale police station, west lancashire. The ban im going to get will lose me my job. i am a milkman and drive electric floats, i have the full support from my boss and he is willing to write a letter if it would help my case. this is my first drink driving offence but i do have 3 points for speeding in the last 12months, i have no other offences.

The precise length of ban will depend on any aggravating factors that the court are told about and any mitigation put forward on your behalf. Arranging quality legal representation in court will ensure that you get the shortest ban possible in the circumstances and could make a real difference to the final result. For example, the court may be persuaded to impose the statutory minimum 12 month ban and to refer you to the drink drive rehabilitation course for a further 25% discount. This could mean you are able to get your licence back after 9 months, rather than waiting 22 months on a worse case scenario.

A lawyer specialising in this type of work would also be able to give you advice about the cogency of the prosecution case and tell you whether the police have followed the correct procedures or not at the police station. A solicitor will check that the machine has self calibrated correctly and that you were given appropriate statutory warnings during the procedure.
