Hi all thanks for reading ,
i have court on 19th this month for drink driving , i blew 42 at raodside and oly 40 at station , now its my first offence , so yes poss 12 mnths witha a reduction with the DD course( HOWEVER ) i used to have an opiot problem all caused from a bad back no excuses ,, i do not have this prob anymore BUT i am on 40 mg methadone ,,, will the court ask for doctors notes because ive been told and know of other people to have indefinately lost there licence through medication ,, please can anyone help ..i cant get a solicitor as im poor ,, many thanks jim p.s sorry if ive already posted this it showed i hadnt but sure i had so may have slightly diffenet tittle ,,, supprising how you cant see when you cant stop crying ,, p,s im meant to be driving my wife to essex , i live in devon , my dad aint gona see another xmas they gave me my court date so quick ,, im gona loose my licence 19th how do i tell my mum and my sis sorry wont be seeing dad alive again ,,, ahh christ what have i done
 
You are going to lose your licence on the 19th, it is unfortunate that your result was 40 because 39 leads to a warning but there is nothing that can be done now. The ban will be 12-16 months but unless you caused a collision then 12 months is most likely, reduced to 9 if you are offered and accept the drink drive course.
i would NOT mention the methadone, it will only complicate things. If you are well regulated on it then you would be fine for driving at the end of the ban, (but check with your GP that he is happy with you driving)
You should tell your wife to get support for her, and then look at how you can get to see your dad. Perhaps go before the 19th. if you can get there then don’t tell your mum and your sister till after Christmas as they have enough on their plate as it is.
 
It's illegal to drive on methadone even if the user is well regulated. Once you begin the methadone treatment programme your driving licence is invalid, I am friends with a lot of recovering addicts all of whom had to surrender their licences until they were off the methadone programme. Once your ban is up you can be dishonest and not tell the DVLA but in the event of a crash and a blood test you would be in a very bad position re drug driving, driving on an invalid licence etc
 
You can drive whilst on a method one programme, subject to the following conditions:

Full compliance with an oral methadone maintenance programme supervised by a consultant specialist or an appropriate health care practitioner may allow licensing subject to favourable assessment and, usually, annual medical review. Similar criteria may apply for an oral buprenorphine programme. There should be no evidence of continued use of other substances, including cannabis.

Group 1
Applicants or drivers complying fully with a consultant or appropriate healthcare practitioner supervised oral methadone maintenance programme may be licensed subject to favourable assessment and normally annual medical review. Applicants or drivers on an oral buprenorphine programme may be considered applying the same criteria. There should be no evidence of continuing use of other substances including cannabis.

Application may be considered when all of the following conditions can be met:

  • stable on the programme for a minimum of 1 year
  • the treatment programme is supervised by a consultant or specialist GP
  • the treatment is for management of opiate dependence
  • oral treatment only (not parenteral) but naltrexone implants may be considered
  • there has been compliance with the programme (adherence to prescription and appointments, and toxicology testing with sustained stability)
  • no non-prescribed psychoactive drug use during the programme or extra use of prescribed drugs such as methadone, buprenorphine, benzodiazepines
  • there is no toxicological evidence of drug misuse
  • there is no adverse effect from treatment likely to affect safe driving
  • there is no alcohol misuse or dependence
  • there are no other relevant medical conditions, eg mental health issues
  • there should be no other disqualifying conditions (these include seizures and cardiac problems).“
