Charged for Failure to provide a specimen for analysis

Firstly I would to state that am so very sorry and worried about my current situation. I have several other convictions for drink driving that I have completed and successfully got my license back last. The last time I was in court was almost 3 years ago.

On Friday I was on my way home when I was stopped and asked to provide a road side sample. I was confused and in stated of disbelief that I automatically went into fight mode (I regret that as I don't think I was over the limit) I refused. I was arrested, handcuffed and taken to police station. Again still in a state of total denial I again totally lost control and refused to provide a sample (not that I wanted to defeat the course of the law .. I was just in state of disbelieve that this can't be happening again).

Anyway I have now bagged a date at the court to answer why I failed to provide sample and with my previous convictions am afraid that I will get custody. I really don't mind being ban for 5 years to be honest. I am really worried as I am the sole bread winner in my home, with 2 children and a wife who had a stroke 1 year ago. If I am sent to prison then my whole life and that of my family will be in homelessness etc etc.

2 Charges:-

1.) Fail to co-operate with preliminary test - motor vehicle offence (recordable), H5623, RT88496
2.) Fail to provide specimen for analysis - vehicle (recordable) H29, RT8810, 803/03

Please help me .. am at a loss of what to do ..

I am sorry to hear about the position that you are in. My first suggestion would be that you read through the information on the drink drivng.org site to understand the charges a little more. I would then urge you to contact a solicitor directly to discuss the case in detail. A motoring law specialist will be free to talk to for initial advice, once they know a little more information about you, and then the appropriate advice can be given to you as to whether you have a defence to the charges or whether your sentence can be reduced with mitigation.
