Caught drinking and driving

Hi

My husband was caught drinking and driving about a week and a half ago. His reading was 61/100. We cant afford a solicitor and it seems as though he cant get legal aid. Are there any state solicitors that will represent him or this not an option.

Unfortunately Legal Aid is means tested. The means test takes into account overall household incomes not just that of the individual. The limits are not very generous and only those with incomes below the national average stand a chance of qualifying. Even for those who do pass the financial test a further, merits test is also applied. This is decided on whether it is in the "interests of justice" for legal aid to be granted. It may be that your husband's case fails this test as well.

The only alternative is to pay privately for a solicitor. We can provide a fixed fee quote to limit the cost if you are interested.
