Just to clarify. You blew 85 on the hand held road side breath testing device and then 65 on the evidential breath testing machine at the police station?

Yes at police station breath specimen 64 then they have taken me to interview on morning

Upon a first conviction, presuming this is your first conviction, of driving with excess alcohol (drink driving) and a breath reading of 65, magistrates sentencing guidelines suggest the imposition of a 17-22 month driving disqualification and a band C fine.

The majority of first time offenders usually get the opportunity to take the drink driving rehabilitation course. On completing the course you will be awarded a reduction of up to 25% off the length of disqualification imposed.

Our guide to appearing at magistrates court for drink driving offences may prove useful to you. Let us know how you get on at court as it may help others who find themselves in a similar situation in the future.

find a solicitor budget solicitor

hi I'm struggling get a solicitor because when I'm looking drink drive solicitor by online they asked quite lots of money
what will I do ?

It depends on what you want a solicitor for.
You say you were involved in a collision and have already been interviewed about it, and your reading was 65.
unless you are looking for a technical defence, where you certainly need a specialist solicitor, and it is certainly going to cost you a lot of money, what you are looking for is a solicitor to put forward mitigation. For this you do not need a specialist solicitor, just one used to doing any mitigation in court. You are looking at a 17-22 month ban, so the best that can be done is to keep the ban at the low end.
You can expect to pay £3-400 for that. Alternatively you can try to see the duty so.icitor at court in the day. Obviously that advice will be brief, and he MAY then speak up for you in court but that will depend on availability with other cases on the day. That is free.

I hate to say this, but I suspect Dharan to be on the wind up.

He types like someone would speak in broken English. Someone with broken English would have no understanding of the written form. Someone who did have a basic understanding of written English would not construct sentences in that manner. Look at the words he understands, and the words he completely misses out.

It's out of context with a basic understanding of written English, as a second language.

Dharan is a city in Nepal.

I blew 63 at the station when I got done, I got 17 months and £350 fine.
The fine is based on your weekly income 150% if I’m correct. I only say this as I have court in little over a week and I’m researching as much as I can. First offence and I’m getting worried this will cost me my job. Anyone who wants to help I’d greatly appreciate it.

First offence will be a 12-month ban straight away.but depend what job you got?

I get that my job is based on having a license, if I get banned I lose my job which means I can’t pay my bills and end up homeless again and it took me 2 years to get out of that. Can you advise?

Might be easiest to start a new thread and give a brief outline of what happened, including which part of the UK you are in, reading at the station and whether there are any factors that may make the court treat it more seriously than the guidelines (i.e. kids in car, accident, trying to evade police, etc)

It’s a pretty straight case in fairness I was driving alone but I was called out and was driving faster than I should of, passed a police car which I did not see and the pulled me over for that breathalysed me and then got arrested. It was in Lancashire I have a clean licence but I don’t think that overly matter and no priors for this kind of thing before.

You're right in that it's likely to be fairly straight forward - expect a ban around 17 - 18 months. The course will knock off 25% so definitely worth asking for if not offered. The good news is you wont be classed HRO so hopefully re-applying for your license will be a lot easier.

it's not a pleasant situation but could have been a lot worse.

I appreciate the feedback thank you. It’s not nice I’ve been court once before do something else but this is completely different and is worrying me more. I get banned and I lose my job I just have to prepare for that.
