I'm a bit curious as to what the breath test differnces are legaly.

As in; with a first breath test of 123 and 4 minutes later a second of 112... is this classified as a signifacant differnce?

if not, what is classified as a significant differnce?

The tolerance in relation to breath tests is 15%. This means that Courts will accept evidence of breath tests where the lower and higher readings fall within 15% of each other.

In relation to your case for a reading of 112 in breath the higher permitted reading would be up to a maximum level of 128.

It is worth knowing that a lot of the time drink driving cases can be defended using technical arguments even where no factual defences exist. If successful, you would be found not guilty.
