Hi,
I recently crashed my car into a fence on a country road, the police were called and I failed the breathalysers scoring 60 micrograms of alcohol in 100 millilitres of breath (the limit is 35) I was taken to hospital to treat my injuries and 4 hours later tested 47 micrograms of alcohol in 100 millilitres of breath at the police station, the police then asked for a blood sample which was taken 2 hours later (having nothing to eat or drink in this period). Has anybody got any advice? I have just started working for a new company and my role is nationally based so involves a lot of travelling should I be convicted, is it at all possible to avoid a driving ban as I will lose my job. I currently have 6 points on my licence for driving uninsured 3 years ago.
 
When a blood sample is provided this replaces the previous breath samples. Therefore, the breath readings you gave are now irrelevant. The limit in blood is 80mg of alcohol in 100ml of blood. If you are convicted of Drink Driving, in the absence of Special Reasons, the Court have no alternative but to impose a disqualification. The statutory minimum is 12 months but can be more, depending on what your reading turns out to be.

My advice would be firstly, arrange your own independent analysis of the blood. This will give you a faster result than waiting for the police, will also enable you to either verify or challenge the police analysis. Secondly I would advise you to consult with a solicitor who specialises in drink driving cases. They will be able to advise you about the strength or weakness of the case against you. Advise you whether there are any grounds on which to challenge the police case and represent you in court to present these arguments. At worst they can present your mitigation in a way that helps secure the most lenient punishment and shortest ban.

Thanks for the advice, I have sent my blood sample off and am waiting for the independant results. Can I still drive as I am currently on bail pending the blood results?
 
Yes you can still drive. Your ability to drive would only be affected if the Court convicted you, at which a ban is mandatory.
 
I have just recieved my independant blood results at 95 milligrams of alcohol per 100 millilitres of blood, what should I do now?
 
Unfortunately this suggests that you will be charged when you attend the police station as their result is likely to be similar.

Your next step is to decide on whether you want to appoint a solicitor to help you with your case.
