Hi there,

About 2 months ago I had a car accident on the motorway that was a result of be drunk driving. The car behind me whom I had overtaken stopped and called the police, when arriving I blew 46 on the breathalyser in the car.

After this I was taken straight to the police station and there had to produce to additional breathalyser samples which were 42 & 43. I was offered the option of blood test which I agreed to.

Since on provides two blood samples on independent and one that the police het analysed, I have had the independent analysed and is came back as 92. This probably means that the police blood sample will be the same outcome.

I have basically lost my job due to above stupid mistake for which I have a lot of remorse for, however my question is that it has now gone 8 weeks and I still haven’t had anything back with regards to the blood test which the police hold and I also wanted to know what the most likely ban & fine amount will be in my case?

Secondly as I am in the process of getting married abroad I will be abroad a couple of weeks next year. My concern is that how can I make the necessary parties aware of this in case I am summoned to magistrates court during this period that I will be abroad?

Please note I have a good driving record and no previous convictions prior to above incident. I have also managed to convince my previous employer to write me a letter of character.

Your assistance would be really appreciated as I am going through the hardest time of my life
 
I was told by the Police officer in charge that the result of the blood alcohol test would come through the posr within 8 weeks and this same letter would work as a charge and would show a court attendence date?

My concern is that 2 months has now gone and I havent heard anything back yet, I have been told that this could take up to six months!
 
You are likely to be sentenced to a ban of 12 - 16 months from the reading that you have outlined. This presupposes that you intend to plead guilty to the offence with which you are charged.


Should you require a Solicitor it is important to instruct one as early as possible. Drink Driving law is a highly specialised area of law. As such, you are best to seek the services of an expert motoring lawyer in order to maximise your prospects of success. This is particularly so if a ban would result in you losing your job. A conviction would also be a criminal one.

Whilst you may be able to use a duty solicitor at Court, their services are not guaranteed. Furthermore, if you are lucky enough to speak to one you may only get 5 - 10 minutes at most and you will have no control over the skill or expertise of the duty solicitor at Court that day.


The police frequently make errors in the procedure, either at the road side or at the police station. Since I havent been charged yet or been summoned to court, my questions based upon that I will be away attending wedding proceedings in India last three weeks of February.

Who do I need to notify about above and what would be the procedure, as I really need to attend this ceremony.

You should make contact with the officer in your case and advise them of when you will be abroad and the date that you return to the country.
 
As per your understanding is there any reason they can deny me to travel, based upon your past experience?

Can I be charged for Dangerous driving, as there was no injury or death (thank god) to anyone in this instance. I am asking this beacuse I have read that this might carry a jail sentence????? :confused:

Unfortunately, you can be charged with dangerous driving, but it would be necessary to view the evidence against you in order to advise you properly.

Dangerous driving can carry a custodial sentence. It is unlikely that the police will charge you with dangerous driving if they have not indicated this at this stage, although it is possible.


When you go back to the police station the police will give you the result of their blood test, and if their independent analysis is over the prescribed legal limit of 80 then you will be bailed to attend at the Magistrates Court which would usually be one or two weeks later. At the police station they will then tell you if you are also to be charged with dangerous driving.
