was at courd today with a reading of 93. I have to go back on tues to be sentenced as they are considering community service due to my reading. I have a totally clean track record including a license for 10 yrs with no blemish. What is the likelihood ill get community service and when can this be done etc as i work mon to friday? I fully understand my mistakes etc so any help would be appreciated, thanks

In relation to the reading, the Magistrates' Association Guidelines state that you should be sentenced to a medium level community penalty which is usually between 80 - 150 hours of unpaid work.

Your are able to complete any hours of unpaid work at the weekend if you wish - subject to a minimum of 7 hours per week.

If the Court wish it could, instead of imposing unpaid work hours, impose a supervision element for 12 - 18 months.

The ban that you can expect to receive is 23 - 28 months.

The above information is in respect of the guidelines and it is possible, with persuasive mitigation and with a skilled motoring law specialist, to obtain a lower sentence.

well to update......i got a fine of £1,545 incl costs due to my income and avoided community service aswell as a 24 month ban......a lesson learned indeed and hope this makes me a better person.

Never ever again.

Could I ask how you managed to avoid community service? I got pulled at 104.

I'm currently working full time (38 hours/week) and have an additional part time job (approx 12 hours/week). I'm also studying part time (4 hours contact time and 8 hours personal study). This makes my working week last 60 odd hours give or take.

A £1500 fine would be a challenge but it would certainly be preferable to unpaid work. I hardly see my wife as it is and an unpaid work order would really put the relationship under stress.

Would the judge take this into account?

Unfortunately, I think it is extremely unlikely that the Court will fine you instead of sentencing you to a community penalty. This is because you are almost 3 times the drink drive limit. The starting sentence in relation to a reading of 104 in breath is a medium level community order.

It may be possible to move away from a medium to low level community order, with very powerful and persuasive mitigation, but I have to advise you that a fine is unrealistic in the circumstances of your case.

i had a meeting with the probation officer before my sentencing where i went over everything, he told me he was going to recommend 60 hours. I told him how i`d left my previous job and started a new one, due to the fact i relied on my car. So when it came to being sentenced i fully expected a community order, howver the judge said he took the fact that id just started a new job into account. Though i was hit by a heavier fine
