Iv recently been caught for my 3rd time.
no excuses but currently going through a divorce and things got the best of me the other night.
my question is, the last time I was caught was 12 years ago now, and I know that the offence comes off your license after 11 years. but when I go to court will I be tried as a first offender considering it has been over 11 years since my last offence it will
They take that into consideration? some advice would be great

You will be sentenced as a first time offender for the guidelines on the length of your ban, BUT it depends on what the prosecutor says when your previous comes up. he may say “he has no unspent convictions” or he may hand in your list of convictions for the magistrates to see, where they SHOULD ignore any spent convictions but as humans they may take them into account....... you would still not trigger the automatic 3 year ban for a second conviction in 10 years though.
