i was breathalysed at the roadside (after a near miss rear end shunt, no damage), at 6pm, and was 83ug. Gave a statement, and have a court date for 27th feb.
need advice on outcome and any mitigating circumstances to say. thanks
 
i should add that apart from the odd speeding fine, I've had a clean licence for 27 years, since 17.
 
A reading of 83ug of alcohol per 100 ml of breath falls within the second bracket of the sentencing guidelines issued to Magistrates. The bracket ranges between 60ug – 89ug and therefore you would fall towards the high end of the scale. In this bracket, the Court will impose a driving disqualification of between 17 – 22 months and either a Band C Fine – Low level community order.

In relation to mitigation, a number of points can be advanced to offer mitigation which can include evidence of good character, remorse and the lack of previous relevant convictions. The Court can also be invited to use its discretion to allow you to complete a drink driving rehabilitation course which will ultimately reduce the period of disqualification by one quarter, provided it is completed within a timescale set by the Court.
