it myfriends 3rd time drink driveing blew 119 at station whats the chances of non custodial centence ?????
any advance on none ? he is very worried has young kids and is in court 22 november.
any advice would be good thanks.

An evedential breath reading of 119 is on the verge of the sentencing guidelines custody threshold for a FIRST offence. Seen as its your friends THIRD offence I think the magistrates will take a very dim view as your friend is showing a pattern of repeat offending.

If at least one of your friends previous convictions for driving with excess alcohol happened anytime within the last 10 years then sentencing guidelines suggest a 36-52 month driving disqualification and a low to high level community order, this is based on a SECOND offence, there are no specific guidelines for a THIRD offence within 10 years. Depending on the mitigating and aggravating factors surrounding the offence in question and the timescale of the offences it may be that your friend will face a much harsher penalty.

In any case your friend will be classed as a high risk offender and will be required to satisfy the DVLA of their fitness to drive by taking a DVLA medical before their driving licence will be returned to them once any period of disqualification has been served.

I would suggest your friend seeks legal advice and representation if they have not already done so.
