Advice needed please !!!

Hi all this has been the first time j have been pulled for dd as i can honestly say i have never ever done till friday i went to bingo with a friend who was designated driver anyway she ended up drinking lots more and as i had only had 2 drinks i said that i would drive us home i had had 2 half of lagers and 2 sips of a vodka and coke but stopped drinking it as i then knew i would have to drive anyway we where making our way home when i was pulled because i had breaklight out the police officer then said he could smell alcohol which was true as i had 2 drinks i told him this and took breath test and failed i was then taken to police station but wasnt breathalysed till 3.30 in morning which came back at 41 mg i was then offered a blood or urine test which i agreed to the doc came and decided my veins where no good so police went for urine this was taken at 4.50 am i was then bailed to await results. The next day i looked up about dd and realised that i was supposed to have had 2 urine samples taken within an hour of each other the first being discarded which never happened i only had 1 taken could anyone tell me what this means im hoping and praying the results come back under but in the case they dont do i have a case for a defence i only weigh 7 st and female plus i hadnt eaten anything that day can this explain y i was over just need some advice i feel so ashamed of myself i generally have never done it before and it wasnt like i got wasted i know i made a mistake but my whole life depends on me having a licence

You are quite right, the requirement is that you provide 2 separate samples of urine within one hour of the request otherwise the sample is incomplete and the police/prosecution cannot rely on it. These must be two distinct and separate samples, not one sample divided into two. If your account is confirmed by the evidence then you have a defence. However, this must be carefully argued and your prospects of success are better with a specialist drink driving solicitor arguing your case.
