I have been caught for drink driving a week last Tuesday Morning at 1.30 am with a reading at the station of 84mg/breath. This is my second offence and I was convicted in March 2002 banned for 11 months and fined £350, that was for a reading of 72mg/breath.
I have spoken to a number of solicitors and have been generally told that this WILL NOT attract a custodial sentence as it is below the threshold nor should it attract a community service order, but I know that for the second offence I WILL be banned for the minimum of 36 months and a fine.
It is just over 8 and half years since my last ban and I did attend the Drink driving awareness course which helped me a lot I kept to the strict rule that if I drank I did not drive or visa versa until I unfortunately got arrested this time due to my dangerous and stupid miss judgement of error. I have been having some stressful and frustrating times at my place of work which I am working through.
I have written a letter to the magistrates court being extremely remorseful and apologetic and have tried to explain my actions, including the situation within my job. I have also requested to attend the Drink Driving Awareness course again and understand that some courts consider it depending on the circumstances.
I have to admit I am nervous and not knowing what to expect apart from not a custodial sentence
