my husband has been caught drink driving on friday.he was 86 in the air.he was taken to the police station,kept over night and they let him go saturday morning.he has the licence since 1996,first time offence(except a speeding fine for which he has done the speed awarness course.)they didn,t take blood or urine samples.he will be in court in two weeks time.is it a possibility to go to prison?or how big the fine will be?we r on benefits for low income,will that affect the fine?he is the only provider of the family,his job depends on his driving licence.

For an evidential breath test reading of 86, magistrates sentencing guidelines suggest a driving ban of between 17 and 22 months and a band c fine. Your financial circumstances will be taken into account. Magistrates can deviate from these guidelines depending on any aggravating and/or mitigating factors present in each particular case.

Your husband should also be offered the drink driving rehabiliatation course which can reduce any driving disqualification received by up to 25%.

A driving ban is obligatory upon conviction, regardless of any personal circumstances including potential loss of employment/job.
