hi I was caught drunk driving on sept 9th 2015 I blew 117 and I still haven't been charged or heard anything back and it has been 7 and half months I had previously been told that if you aren't getting charged you wont hear anything back, do you think it has been long enough to assume i'm not getting charged?

Doddsy,

Whilst most road traffic offences carry a time bar for prosecution of 6 months, it does not apply to drink driving cases. This means, therefore, that strictly speaking you can still be competently prosecuted. However, the passage of 7 and a half months would suggest that nothing is going to come of this incident, and certainly any chance there is diminishes with each passing week.

You are correct to identify that you would not receive any intimation that there will be no proceedings against you; the Crown only contact you if you are to be prosecuted.

Kind regards,

Michael Lyon
