I need some advice for my wife , she was arrested after she crashed the car into a field ( no other vehicles or people/property we involved) This is her 1st offense and has never had any points etc. She had previous challenges with depression but took herself off the med`s and has been fine for months until this happened. We have a disabled son with a lot of challenges which is part of the issue and also some family issues. On the day in question she was on a downer and had a fight with her mum. She was totally honest with the police and pleaded guilty. She is planning on going back to the doc`s for help but is worrying herself to the point of making things worse that she will get a custodial sentence. She is a stay at home mum of 4 ( all school age) and if she does get a custodial sentence i will have to give up my job and we will likely lose our home which is why i am asking for some guidance...... can you advise please

The court will initially consider the reading produced as the factor that indicates that custody must at least be considered. The threshold for considering imposing a prison sentence for this offence is a reading of 120µg of alcohol per 100ml of breath. The reading produced by your wife passes that threshold. That does not, however, guarantee that a prison sentence will be imposed by the court. Everything you mention about the impact any prison sentence will have on the wider family will be considered. Any underlying issues are also necessary to explore and present to the court. I would highly recommend speaking with a specialist to discuss the case and the circumstances in more detail.
