Hi,

stupidly, I drove whilst drunk the other night and came off the road into a bush where police came to the scene. I cooperated with the police and spent the night in prison until fit for interview - i blew 77.

it’s no excuse for putting people at risk however after separating from my fiancée I have been showing signs of severe depression and have subsequently been given antidepressants.

I was wondering what the most likely penalty will be given the circumstances and if it’s worth getting a private solicitor?

Many thanks.

The reading is the first place to start when considering the likely penalty. A reading of 77 µg of alcohol per 100ml of breath is a reading that will mean you will be considered in the second sentencing bracket. This means that you will face a ban of between 17 and 22 months together with either a fine or a community order. Representation can help direct the court to the most appropriate penalty. The court can take the circumstances of the offence into consideration as well as the background of the offender (you). If you do seek representation, it is advisable to use a specialist.
