I have been charged with Drink Driving and Failing to stop - its my first offence and have never been in trouble before.

I left work and then stupidly drove home from the train station, I hit a car that stopped at a round about, I subsequently got out of the car - checked with person who I hit then I just had a mad moment and drove away. I drove home parked the car about 100 yards from my house as I realised I was in trouble - the car was not hidden and by the time I looked towards my house the police were there and handed myself straight into them.

I blew 83/85, and spent the night in jail - interviewed and charged with drink whilst unfit and failing to stop.

I never go out and drink as I drive and on Fridays I always take my son to football but as it was half term he did not have it.

I accept my wrong doing - my biggest concern is a custodial sentence, I will lose my job, our house is rented so my family will lose their home.

I'm so concerned, what is the likelihood of a jail sentence?

A reading in the 80s does not put you at risk of custody on its own but, together with the additional allegation of failing to stop after an accident, can potentially put you at risk of custody. A full and frank admission during interview and a guilty plea at the first appearance, together with well presented mitigation centring on the circumstances of the offence and your personal circumstances and good character, can put you in the best possible position to avoid any risk of custody. It is certainly worthwhile speaking with a specialist to obtain advice about your options. You can contact a specialist on 03332009852.
