I have a court case for drink driving on 10th July. I have never done this before. I have only had a drinks twice in June, but due to working long hours over the last few weeks, and also having two children (single mother), I have hardly had any sleep and on 22nd June drank two large wines on an empty stomach and drove home. Crashed the car with my two children in the back. All absolutely horrific. The three of us are fine, but I was arrested and my children taken to hospital to be looked over. Fortunatley a friend went to the hospital with them. I was over by 65.
Again I stress that I have never done this before.
The remorse since has been worse than the actual arrest!
It was just weeks of stress coming out in one stupid night which I have relived day after day.
I assume though that I will be given a heavy fine and a disqualification.
I am in a lot of debt also which I am paying back monthly for the next many years, so a fine is going to be horrendous as well as not being able to drive the children around to their many activities.
The ex is no help at all and its all me.
Any advice would be greatly received.

A reading of 65µg of alcohol per 100ml of breath in breath puts you in the second sentencing bracket meaning that you face a ban of between 17 and 22 months together with a fine that will be assessed by considering your income (a starting point of 150% of your net weekly income) OR a community order.

You should be given the chance to complete a drink driving rehabilitation course which can reduce your ban by up to 25%.

The fact that there was an accident and you had your children as passengers can aggravate any penalty. It can mean that you are considered in a higher sentencing bracket due to the aggravation involved. That would mean potentially an even lengthier ban and will almost certainly mean a community order will be considered instead of a fine.

I would certainly recommend at least obtaining some further advice about how to advance any mitigation to hopefully help steer the court towards keeping your penalty considerations in line with the guidelines as per the reading. You can contact a specialist on 0333 323 3734.
