Hi my name is Jay, i really would be grateful if i could gain some legal advice as this is all new to me. I will tell you a little about me first,I have had a full clean driving licence for 21 years with no points and no convictions. i am married and a father of two children, i have been under imense stress for the past 6 months as my father has been diagnosed with terminal cancer, he has been told he may have 6 months to live.
my father was no longer able to drive since December 2016 and i have had to take over and keep the car and take my father to the hospital, shopping etc.
on the day i was arrested i was on my way to the rubbish depo to drop rubbish for my father and i admit carelessly for the first time i drank just over 1 can of beer. i know it was a silly mistake and i will live with this for the rest of my life.
on my way back from the depo i was pulled over on a dual carriage way for driving at 55mph. the officer then asked me to do a breath test and the reading was 54, the officer arrested me and i had to go to the station.
At the station he checked me again and my reading was 72, the officer said because i am slim my body consumption cannot take it.
I really do for not want my father to know about this as it will put alot of strain and stress on him, all i want to do is help my father as much as i can and not upset him.
my court case is on Thursday 8th June, as this is new to me i am not sure what to expect and what to do. I am only using my fathers car to take him to the hospital and back and just for days out for him.
i would appreciate any advice

Drink driving is a strict liability offence so irrelevant of why your are over the limit, where you have knowingly consumed alcohol that has put you over the limit, even if not expected, the offence is made out. This means that, in your case, if you enter a guilty plea you will face a disqualification of between 17 and 22 months and EITHER a community order OR a fine. It is important to seek specific advice about your case as the court can consider both the offence and the offender when considering any penalty.
