I was stopped in April for drink driving and gave a positive test at the roadside. At the station I gave a reading of 44. I noticed the time on the breathalyser print out was wrong by two hours (it was last calibrated in October 2016). Is it an issue that the time would be wrong?
 
There could be a number of explanations for this. It could be that the time has been incorrectly manually updated when changing from GMT to BST. It could, however, be an issue with the machine. It would require further investigation with the assistance of an expert. No device is infallible and case law is available to support this contention. That said, there would need to be some definitive evidence from any expert to suggest to the court that there is a reasonable doubt surrounding the reliability of that machine. I would recommend contacting a specialist to discuss this further.
