Early Removal of Driving Disqualification

If you have been banned for a period in excess of 2 years and there is no requirement for you to complete an extended re-test upon expiry of the ban then you can make an application to the court for early removal of your ban. You can only do in the following circumstances:
1. If the ban is less than four years (but more than 2) you can apply when two years of the ban have expired; OR
2. If the ban is for less than 10 years but not less than four years you can apply when half of the ban has expired; OR
3. If the ban is for 10 years or more then you can apply after five years of the ban has expired.
You must apply to the magistrates' court that imposed the original ban. The court would need to be satisfied that there is good reason to remove the ban. That would usually relate to your personal circumstances. If you are eligible to make the application I would suggest you speak to a specialist regarding the merits of your particular application.
