My son has a provisional licence and was caught drink driving on his 50cc moped. He has to appear in court on 3rd of May. He is 17. What should I do ? He had 70 micrograms of alcohol per 100 on the breath test.
With new sentencing guidelines coming into force from 24 April 2017 a reading of 70µg in of alcohol in 100ml of breath will mean that your son is liable for a disqualification of between 17 and 22 months together with either a fine or a community order. I would recommend that he is represented at court given that the sentencing guidelines are yet to be tested and it is important that all relevant factors are brought to the court's attention to help minimise any penalty to be imposed.
