Dear all,
I hope you are well.
I am international student. I have a court because the police stopped me and the breathing test for alcohol was positive (50). At that night my friend has party and he invite me. I never drink before and he give me a beer, I was shy to refuse it. Also, I don't know that beer contain alcohol . The car have valid insurance, MOT and road tax. I have an international license which the police told me that night I can't drive more than 12 months since I came here, and I have been here since Sep 2015. Last year when I planed to get the UK license one of the international student replayed an email which include DVLA answer for question about international license, and the DVLA explains that the 12 months started from last entrance to the UK. My last entrance was in Jan 2017. Moreover, when I did new insurance for second year the insurance company accept my license. When the police stopped me I was close to my flat and I was aware and conscious 100% and I did what the police man asked my exactly. I have no traffic penalties at all. What could happen in the court?

The rules regarding whether you are classed as a resident can be complicated but in short you’re normally a resident if you have a permanent address in Great Britain that you’ve lived in for at least 185 days within a 12 month period. That doesn't mean you start from scratch if you leave to go back to your country of origin for a short break. It isn't clear from your post what you have been charged with other than drink driving. It may be that you have been charged with drink driving, driving otherwise than in accordance with a licence and driving without insurance. The more serious of those offences is drink driving as this means, with a reading of 50µg, you will face a ban of between 12 and 16 months and a fine. I would recommend you contact a solicitor to discuss the case in more detail to obtain a view regarding the charges you face and any potential defences that may be available.
