Fighting the drink driving charge with help of solicitors

Hi , got caught driving after a BBQ and reading was 57*. Question is there anyway to avoid a ban? case dropped? with the help of these drink driving solicitors online i.e Geoffrey miller solicitors , they seem to be featured even in thegaurdian? Quite pricey but is there any chance they win or is just another scam?

It is certainly possible to have cases either dropped by the prosecution or successfully defended at trial. However, the only way to advise regarding this point with any clarity is to discuss the case in some detail. I am aware of some firms who will guarantee that they can find a defence, which I am always sceptical of as each case needs to be assessed on it's own facts.

I would certainly not describe Geoffrey Millers as a scam, nor any other reputable firm who deal with this area. It is a question of whether you are willing to fund the case to explore the possibility of a technical error being made by the police during the intoxilyzer procedure.

ok what detail would be helpful to assess the case? Also is it possible to plead not guilty to buy sometime and how long would the re-trial be set for approx? Reason being I know solicitors would certainly charge a good amount for such cases knowing people depend on their cars for work/lifestyles etc. thank you
 
The information would specifically pertain to the intoxilyzer procedure and the circumstances of the offence. This would then make it clear whether any issue could be raised as to whether the police can prove that you were driving, whether the statutory warning was given at the police station, whether the police had followed the correct procedures at this time etc. Very often it is necessary to obtain the MGDD/A form (the form completed by the officer's during the intoxilyzer) and CCTV footage from the procedure to check all of the relevant issues.

You can enter a not guilty plea to check the evidence and see if you have grounds to defend that charge. If you plead not guilty you would have to give reasons for this and it cannot be put forward simply on the basis of wanting to delay the procedure. There is no set time frame for how long the case is adjourned when listed for trial, although typically this is somewhere in the region of 3 months.

In respect of fees I cannot comment upon what any other firms may be quoting for the matter or why. There is however a significant amount of work involved in running a defence on a technical basis which is normally the basis for any fees quoted, although some firms will no doubt quote at the higher end of the scale.
